Welches Recht ist gerecht? So lautet die Grundfrage der Rechtsethik. Die Rechtsethik fragt also nach der Rechtfertigung und Kritik des Rechts. Dabei geht es ihr nicht nur wie der dogmatischen Rechtsanwendung um die Analyse der Normen und Wertungen des geltenden Rechts, sondern um einen ethischen Maßstab des Rechts.

Sharp-eyed readers will have noticed a small but very significant difference between the Spring 1989 Owl and previous issues. The Spring issue was the first to be accomplished completely by desktop publishing instead of typesetting. The “desk” from whose “top” this Owl flew is mine, equipped with an IBM-PC, a modem, two 5 1/4 inch 360 K floppy drives, a 40 megabyte hard drive, a Hewlett Packard LaserJet II printer with a Times Roman soft font, and the newest version of (...) Microsoft began our long experiment with electronic preparation of The Owl about three years ago. Our motive in pursuing this project was to improve our efficiency, not to have a few new toys. During that experiment we made a few mistakes, some of which found their way into The Owl itself. We apologize to all the authors and readers who were affected by them, and especially by the tardiness of recent issues. But we have learned a lot too. Among what we think we have learned is how to avoid repeating our mistakes. The new production system we have developed is not only faster, easier, and cheaper for us editors, but also, we hope, more convenient and more dependable for our authors. This paper considers various senses of the notion of identity and describes the strongest sense of the term—what it labels “absolute identity.” Absolute identity combines monistic identity of all in all as one substance with the absence of internal differentiation. The paper explores the possibility of absolute identity along three lines—linguistic, mental, and ontological. It determines that though there are serious difficulties, linguistic and mental, involved with positing absolute identity the possibility of its coming to be real cannot be ruled (...) out. Finally, on grounds of its lack of coherence-functionality absolute identity is rejected as an adequate conception of the world. ABSTRACTThe ability to evaluate scientific claims and evidence is an important aspect of scientific literacy and requires various epistemic competences. Readers spontaneously validate presented information against their knowledge and beliefs but differ in their ability to strategically evaluate the soundness of informal arguments. The present research investigated how students of psychology, compared to scientists working in psychology, evaluate informal arguments. Using a think-aloud procedure, we identified the specific strategies students and scientists apply when judging the plausibility of arguments and classifying (...) common argumentation fallacies. Results indicate that students, compared to scientists, have difficulties forming these judgements and base them on intuition and opinion rather than the internal consistency of arguments. The first meeting of the Schleiermacher Studies and Translations Group was held August 8–11, 1986, at Drew University. The purposes of this “Schleiermacher Summer Camp” were to plan the translations into English of Schleiermacher’s complete corpus, including sermons and letters, as well as some prominent German secondary sources, and to provide an opportunity for the initial participants in this ambitious project to meet each other and learn each other’s methods. presuppositions, interests, and goals. From an early age she was attracted to Bolshevism, became an anarchist and helped Trotsky. She joined the International Red Brigade to fight Franco in the Spanish Civil War. An agnostic, she experienced a profound religious conversion, yet never converted to the Christian faith to which she was so deeply attracted. (...) The contribution starts with the observation that Kant mentioned Human Dignity in his main works with great variety in emphasis. In the 'Grundlegung' from 1785 we find a significant treatment and again in the 'Tugendlehre' from 1798 but none in the 'Kritik der Praktischen Vernunft' from 1788 and in the 'Rechtslehre' from 1797. This needs an explanation. In the 'Grundlegung' human dignity is not attached to the second formula of the categorical imperative, the formula of self-purposefulness, as it is often (...) assumed, but to the third formula of a kingdom of ends. It is there explained as self-legislation. This placement needs also an explanation, which is attempted by the article. In the 'Tugendlehre' human dignity is then explained as self-purposefulness. So Kant changed his understanding of human dignity from the 'Grundlegung' to the 'Tugendlehre'. But the question is: why? (shrink)

Eine Analyse der Politischen Philosophie der Neuzeit kann – soll sie nicht lediglich einzelne Autoren oder Werke reihen – zwei methodische Wege einschlagen. Sie kann zum einen mit einer detaillierten Werkinterpretation wichtiger Denker wie Hobbes, Locke oder Kant beginnen und quasiinduktiv den historischen Fortgang der Hauptdiskussionen zu rekonstruieren suchen. Sie kann aber auch wesentliche abstrakte Verlaufskategorien vorschlagen, mit deren Hilfe dann umgekehrt in einem quasideduktiven Konkretionsschritt die Beiträge eminenter Denker möglichst gut verstanden, eingeordnet und gewürdigt werden.Der vorliegende Text wird zum (...) Zweck der Beurteilung dieser beiden großen Alternativen zunächst einige Anforderungen vorschlagen, die derartige abstrakte begriffliche Kategorien erfüllen sollten, um zum Verständnis der Ideengeschichte der neuzeitlichen Politischen Philosophie beitragen zu können . Non-verbal enrichment in the form of pictures or gesture can support word learning in first and foreign languages. The present study seeks to compare the effects of viewing pictures vs. imitating iconic gestures on learning second language (L2) vocabulary. In our study participants learned L2 words (nouns, verbs, and adjectives) together with a virtual, pedagogical agent. The to-be-learned items were either (i) enriched with pictures, or (ii) with gestures that had to be imitated, or (iii) without any non-verbal enrichment as (...) control. Results showed that gesture imitation was particularly supportive for learning nouns, whereas pictures showed to be most beneficial for memorizing verbs. These findings, suggesting that the type of vocabulary learning strategy has to match with the type of linguistic material to be learned, have important educational implications for L2 classrooms and technology-enhanced tutoring systems. The article aims to clarify Kant's concept of law, which he developed in the “Metaphysische Anfangsgründe der Rechtslehre” from 1797. Decisive for Kant's concept of law is the distinction between internal and external relations of persons. Law is restricted to external relations. So the crucial question is: Where does Kant draw the line between internal and external relations? Four possibilities are analysed in an order of increasing extent: only causal consequences of our actions in the external world beyond our bodies; (...) causal consequences in the external world plus our externally empirical sensible bodily behaviour; causal consequences in the external world plus all physiological changes in the actor like nerve stimulations and brain activities; all features of plus all non-a-priori mental and emotional changes like emotions, inclinations, empirical concepts, hypothetical imperatives etc., in sum: Kant's division between homo noumenon and homo phaenomenon. While modern interpretations would perhaps endorse possibility, Kant has chosen – so the main argument of the article – the widest possible alternative. This brings him to a very extensive concept of law. Only in reflecting this wide extent of Kant's concept of law, we are able to understand his philosophy of law. (shrink)

Kenley Dove’s article [OWL, IX-4] seems to overlook that certain thinker who could probably be the key to the proper elucidation of Hegel’s thought on creativity, i.e. Plotinus. Dove’s threefold breakdown of classical Greek and medieval Christian ideas of creation is cogent, though he fails to include the Neo-Platonic bridge which could not only harmonize for him the “deterministic” metaphysics of the Greeks with the ex nihilo “free-act-of-God” metaphysics of Aquinas, but also provide him with a way to understand that (...) In his 1985 book on philosophy and atheism, the Canadian thinker Kai Nielsen, a prolific writer on the subject, wonders why the philosophy of religion is ‘so boring’, and concludes that it must be ‘because the case for atheism is so strong that it is difficult to work up much enthusiasm for the topic.’ Indeed, Nielsen even regards most of the contemporary arguments for atheism as little more than ‘mopping up operations after the Enlightenment’ which, on the whole, add little (...) to the socio-anthropological and socio-psychological accounts of religion provided by thinkers like Feuerbach, Marx and Freud, as any ‘reasonable person informed by modernity’ will readily acknowledge. On this view, the answer to Kant's question – ‘What may we hope?’ – does not gesture towards a resurrection and personal immortality, but instead to the death of religious discourse itself: I think, and indeed hope, that God-talk, and religious discourse more generally, is, or at least should be, dying out in the West, or more generally in a world that has felt the force of a Weberian disenchantment of the world. This sense that religious convictions are no longer a live option is something which people who think of themselves as either modernists or post-modernists very often tend to have. (shrink)

. Gustav Radbruch is one of the most important German-speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo-Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative-holistic understanding of philosophy as a source of wisdom and meaningfulness. Kant, on the other hand, (...) belongs more to a fundamentally different, critical camp of philosophy. Although Radbruch has incorporated Kantian Elements into his theory, he is rather a member of the affirmative-holistic camp. In the end the question will be raised as to what ought to be preserved of his philosophy. (shrink)

In recent years, the public sector in many countries has had difficulty keeping abreast of social problems due to restricted financial resources and limited organizational capacities. As a consequence, entrepreneurs have started to address social welfare issues that the public sector has been unable to tackle with an innovative approach called social enterprise. The authors present research on the future prospects of social enterprise as a sustainable business model for industrialized countries. As there is a lack of historical and current (...) data, the authors aim to contribute to and structure the debate about the potential of the concept. Therefore, the authors provide initial data from a Delphi survey on the future development of social enterprise in a multistakeholder environment. Experts from academia, business, nongovernmental and governmental organizations, social enterprise investors, and social entrepreneurs evaluated 16 projections for the year 2030. Based on these results, the authors present comprehensive scenarios of four different possible developments of the future of social enterprise in Germany. (shrink)

The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals' concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. Agreement attraction is a cross-linguistic phenomenon where a verb occasionally agrees not with its subject, as required by grammar, but instead with an unrelated noun (“The key to the cabinets were…”). Despite the clear violation of grammatical rules, comprehenders often rate these sentences as acceptable. Contenders for explaining agreement attraction fall into two broad classes: Morphosyntactic accounts specifically designed to explain agreement attraction, and more general sentence processing models, such as the Lewis and Vasishth model, which explain attraction as a (...) consequence of how linguistic structure is stored and accessed in content-addressable memory. In the present research, we disambiguate between these two classes by testing a surprising prediction made by the Lewis and Vasishth model but not by the morphosyntactic accounts, namely, that attraction should not be limited to morphosyntax, but that semantic features of unrelated nouns equally induce attraction. A recent study by Cunnings and Sturt provided initial evidence that this may be the case. Here, we report three single-trial experiments in English that compared semantic and agreement attraction and tested whether and how the two interact. All three experiments showed strong semantically induced attraction effects closely mirroring agreement attraction effects. We complement these results with computational simulations which confirmed that the Lewis and Vasishth model can faithfully reproduce the observed results. In sum, our findings suggest that attraction is a more general phenomenon than is commonly believed, and therefore favor more general sentence processing models, such as the Lewis and Vasishth model. Zum Verständnis des Kantschen Rechtsbegriffs ist es notwendig, sich die Diskussionslage seiner intellektuellen Umgebung vor Augen zu führen, auf die nach längerer Ausarbeitung 1797 sein rechtsphilosophisches Hauptwerk Die Metaphysik der Sitten. Metaphysische Anfangsgründe der Rechtslehre traf. Die Naturrechtsentwicklung des 18. Jahrhunderts hatte – zumindest in Deutschland – zur Herausbildung eines engeren, äußeren und auf äußeres Verhalten gerichteten sowie mit Zwang verbundenen, „strikten“ Naturrecht geführt, das besonders für das positive Recht bestimmend war. Diese Verengung auf ein striktes, äußeres, mit Zwang verbundenes (...) Naturrecht war allgemein anerkannt und wurde als Fortschritt begrüßt. Man muß annehmen, daß sie Kant wohlvertraut war. Sie wird etwa in Baumgartens Initia Philosophiae Practicae und auch in Achenwalls Jus Naturae erläutert, zwei Schriften, nach denen Kant Vorlesungen gehalten hat.
